Hegel’s absolute idealism, in fact, did try to surpass Kant’s restrictions, but he did it by way of a complete and radical reconstruction of the notion of a thing-in-itself, and thereby, all that which for Kant was ‘illegal’, so to say. Hegel, however, fundamentally criticized Kant for offering merely a ‘formal’ model of normativity that cannot sufficiently comprehend human action as free. Instead, Hegel argues in his doctrine of ethical life (Sittlichkeit) that the embeddedness of the acting subject must be taken into account when identifying normativity. These two points are connected: for Kant and Fichte, cognitive and practical normativity (how we ought to think, what we ought to do) find their origins in the (either logically or practically necessary) cognitive acts of individuals, while for Hegel, both kinds of normativity are the result of collective, historical development. In recent years Karl-Otto Apel and I have begun to reformulate Kant’s ethics by grounding moral norms in communication, a venture to which I refer as “discourse ethics.”¹ In this chapter I hope to accomplish two things: first, to sketch the basic idea of discourse ethics and then to examine Hegel’s critique of Kantian moral philosophy.
